Sweepstakes Official Rules January 27, 2008.
THE FOLLOWING ONLINE PROMOTION IS INTENDED FOR PARTICIPATION IN THE UNITED STATES AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW. IT IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW AND NOT INTENDED TO BE OFFERED IN ANY JURISDICTION IN WHICH IT DOES NOT COMPLY WITH LAW. NO PURCHASE NECESSARY TO SUBMIT ENTRIES OR WIN PRIZE. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
1) ELIGIBILITY: This Sweepstakes is offered only in the 50 United States and the District of Columbia ("United States"), and is open only to those 13 years of age and older who are "customers" of Prince Sports, Inc. Employees of Prince Sports, Inc. (“Prince” or the "Sponsor"), its parents, affiliates, sponsored players and organizations, Prince retailers, subsidiaries and related companies, advertising and promotion agencies, and the immediate families (spouse, and parents, siblings and children, and each of their respective spouses regardless of residence) and household members of each, whether related or not, are not eligible. Void where prohibited.
2) HOW TO ENTER: No purchase necessary. Sweepstakes begins at 12:00:01 a.m. Eastern Time ("E.T.") on January 27, 2008, and ends at 11:59 p.m. E.T. on December 31, 2008 (the "Entry Period"). Web users on www.princetennnis.com will be brought to a dedicated promotions page to www.princetennis.com/tennis/files/showusyouroface.aspx, encouraging users to “Show Us Your O Face” by submitting pictures from actual tennis competition that captures the emotion and energy of a great shot or point. Submissions will be collected through an upload database managed by eMedia EFX. Once photos are submitted, Prince Sports will retain the rights to post submissions on www.princetennis.com and other sites for publicity value. There, submitters will be also prompted to enter required user and contact information in order to be instantly entered into the sweepstakes where they will be able to win prizes from Prince Sports, Inc. Winners will be selected at random each month from the overall database of entrants based on the “quality” of the photo as determined by the Sponsor, in its sole discretion The odds of winning will depend on the number of entries submitted and by the “quality” of the photo and connection to the overall promotion (as determined by the Sponsor). Automated/Multiple Entries are prohibited. Prince Sports, Inc. also retains the rights to refrain from posting specific submissions due to content, available space on the site or any other reason.
3) PRIZES:
Twelve (12) Monthly Prizes – one each to be awarded monthly.
Each month Prince will designate one entrant the O Face of the Month and provide the winner with a new O3 racquet of his or her choice (if available). Team submissions are accepted, however only one new O3 racquet will be awarded for the winning photo each month. Twelve monthly winners will be awarded and posted on the site. Approximate retail value per racquet: $200
4) PRIZE RESTRICTIONS/CONDITIONS: Prizes are non-transferable. No cash redemption or other prize substitution. except by Sponsor, in its sole discretion if featured prize becomes unavailable.
5) NOTIFICATION OF WINNERS/AWARDING OF PRIZES: Prince will select the twelve winners of each of the prizes based on its judgment of the photograph submissions in accordance with timing set forth above,. Each winner will be required to have completed all required fields and completed all required information in order to be eligible. Once a winner is selected, Prince will contact him or her directly from the information entered in the contest form page to confirm shipping information and any additional details pertaining to. Prince will use reasonable commercial efforts to deliver prizes within 90 days of notifying the winner. If winners are unreachable via phone or email for more than 30 days, prize will be forfeited and awarded to an alternate winner. Winners are responsible for all taxes on prize. In the event of a dispute regarding the identity of a winner, based on an email address, the winning entry will be declared made by the authorized account holder of the email address submitted at the time of entry.
6) ADDITIONAL TERMS: By entering and/or accepting a prize, the Sweepstakes entrants agree to (a) abide by these Official Rules and the decisions of the judges and Sponsor which shall be final, and (b) to release, discharge and hold harmless Prince Sports, Inc, and its parents, affiliates, subsidiaries and related companies, divisions, advertising, web and promotion agencies and the respective employees, directors and officers of the foregoing (collectively "Releasees"), from and against any/all claims, losses, injuries or damages, including death, resulting from the acceptance, use or misuse of any prize and/or participation in any prize related activities or any travel related thereto, and (c) allow Sponsor and/or its designees the use of a winner’s name in any online promotion of the contest and as part of ongoing list of winners to be posted on the www.princetennis.com site. for promotion and publicity purposes without additional compensation except where prohibited by law. In addition, Prince has the right to retain the information provided by entrants for use in future marketing or communications efforts. Entrants will have the right to refuse or to opt out of this communication at any time. CAUTION: Any attempt by an entrant or any other individual to deliberately undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil law and, should an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor reserves the right to cancel, suspend, or modify the Sweepstakes if technical problems renders such action necessary. Sweepstakes is governed by laws of the United States with venue in New Jersey for the resolution of all claims and disputes.
7) LIMITATIONS OF LIABILITY: Releasees are not responsible for any late, lost, illegible, incomplete, misdirected or postage due mail/entries, stolen entries, nor are they responsible for incorrect or inaccurate information, whether caused by any of the equipment or programming associated with or utilized in the Sweepstakes; any technical or human error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction. If, for any reason the Sweepstakes cannot be conducted as planned by reason of tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this Sweepstakes and may conduct a drawing and select winners from among all eligible entries received prior to the action taken. Without limiting the foregoing, all aspects of this promotion are provided "as is" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions may not allow limitations or the exclusions of liability for incidental or consequential damages, or exclusion of implied warranties so some of the aforementioned limitations or exclusions may not apply.
